User Responsibility
The user is solely responsible for the content they upload or publish on Vitamarinaweb (texts, images, videos, audio, links, etc.). By uploading content, the user declares and warrants that they have all necessary rights and that such content does not violate the rights of third parties (including copyrights, related rights, trademarks, image, privacy).
Publication of user content (UGC)

The user is solely responsible for the multimedia content (including videos, images, texts, links, and embedded materials) they share, upload, or publish on Vitamarinaweb.
It is strictly forbidden to upload or publish audiovisual content on the site for which the user does not possess the rights of use or for which express authorization has not been obtained from the rights holder.

Vitamarinaweb does not directly host content from external platforms nor claims any rights over them.
Any violations of copyright or other third-party rights remain the exclusive responsibility of the user who published or embedded the content.
The user agrees to indemnify and hold harmless Vitamarinaweb and its administrator from any claim, damage, loss, or request for compensation arising from the publication, embedding, or sharing of unauthorized content.
Vitamarinaweb, in case of a report or suspicion of a violation, reserves the right to remove without notice any content deemed harmful to third-party rights or contrary to current legislation.
The publication of content on Vitamarinaweb does not entitle the user to any compensation, economic prize, payout, or other consideration, unless otherwise agreed in writing with the Owner.
The user declares to waive from now on any future economic request based on the creation, publication, or maintenance of the content, for any cause or title.
License to Vitamarinaweb
By publishing content, the user grants Vitamarinaweb a non-exclusive, free, transferable, and sublicensable worldwide license to use, reproduce, distribute, communicate to the public, display, and make technical modifications necessary solely for the provision of the service (hosting, display, cache/backup copies, thumbnails/previews).
To offer detailed forecasts on weather and marine conditions, tides, lunar phases, and fish activity, Vitamarinaweb uses external open data services, including Open-Meteo, WheaterAPI, and WorldTides. Data is retrieved from our servers and displayed to users without installing profiling cookies or tracking tools on the user's device.
The information provided is for purely informational purposes and does not in any way constitute
professional advice. Vitamarinaweb does not guarantee the absolute accuracy of the data
and assumes no responsibility for any variations, inaccuracies, or consequences arising
from their use, including but not limited to fishing, diving, or navigation activities.
Violation Reports (Notice & Takedown)
If you believe that any content violates your rights, please send a report to aaa411@hotmail.it
indicating:
Precise URL of the disputed content;
description of the protected work and proof of your right;
your contact details (name and email);
declaration that the report is made in good faith and is truthful;
declaration that you are the rights holder or authorized to act on their behalf.
Upon receiving a complete report, we may remove or disable access to the disputed content and, if appropriate, inform the user who published it.
Counter-notification

Abusive reports

Repeat offenders
Vitamarinaweb may suspend or close accounts that repeatedly violate intellectual property rights or that receive recurring substantiated reports.
Repeat offenders
In the event of three (3) substantiated reports of intellectual property violation within a 12-month period, Vitamarinaweb may suspend or close the account and prevent related new registrations.
Indemnity
The user agrees to indemnify and hold harmless Vitamarinaweb from claims, damages, costs, and liabilities arising from content uploaded by the user that violates third-party rights or the law.
Role of the service (UGC hosting)
Vitamarinaweb hosts user-generated content and does not perform prior checks. We cooperate with reports and remove illegal content without undue delay, in accordance with applicable legislation.
Sales limitations
The purchase of "Mega Like" packages on Vitamarinaweb is exclusively reserved for private consumers (natural persons) acting for personal and non-professional purposes.
Purchases by companies, professionals, entities, or organizations with a VAT number are not permitted.
Any orders placed by subjects other than private consumers may be canceled and refunded.
All purchases made on Vitamarinaweb are managed via the Lemon Squeezy service (Merchant of Record), which handles payment processing, issuance of purchase documentation, management of applicable taxes where required, and other fulfillments connected to the transaction, according to its own Terms and Conditions.
Mega Likes and payments
Function of Mega Likes
Mega Likes are virtual credits internal to the Vitamarinaweb platform, purchasable by users through paid packages.
Mega Likes are used exclusively to enhance, symbolically reward, and highlight content published by other community users, such as posts, images, videos, or other content permitted by the platform.
Mega Likes do not constitute money, electronic money, payment instrument, voucher, investment, refundable credit, or convertible asset.
No monetary value
Mega Likes have no direct or indirect monetary value.
The purchase of Mega Likes does not entitle the user to:
* conversion into cash;
* economic prizes;
* payouts;
* refunds not required by law or the payment manager;
* compensation;
* interest;
* dividends;
* profit shares;
* rights to revenues generated by the platform.
Mega Likes can only be used within Vitamarinaweb and according to the functionalities provided by the platform.
No payouts to users
Users who receive Mega Likes from other community members do not accrue any automatic right to receive money, economic prizes, refunds, compensation, or other monetary benefits.
Received Mega Likes have an exclusively internal, reputational, and symbolic function, and may contribute to the visibility of content within the community according to the technical rules established by Vitamarinaweb.
Vitamarinaweb does not guarantee any earnings to users and does not act as a financial intermediary, collect money on behalf of third parties, or redistribute sums among users.
Use of Mega Likes
Mega Likes can be used by users to express enhanced appreciation for content published by other community members.
The use of Mega Likes must be correct, lawful, and compliant with Vitamarinaweb's Terms of Service.
It is forbidden to use Mega Likes to:
* artificially manipulate the visibility of content;
* create coordinated or fraudulent exchange systems;
* simulate non-genuine interactions;
* promote prohibited content;
* bypass the platform's rules;
* engage in abusive, deceptive, or bad faith activities.
Vitamarinaweb reserves the right to suspend, cancel, remove, or correct Mega Likes obtained or used improperly, fraudulently, or contrary to these Terms.
Paid packages
Mega Like packages can be purchased via the payment page indicated by Vitamarinaweb.
Payments are managed via Lemon Squeezy, acting as Merchant of Record. The technical processing of transactions may occur via the payment infrastructure used by Lemon Squeezy.
The entity managing the payment may handle, according to its contractual terms, the processing of the payment, sending the receipt, managing any taxes applicable to the transaction, refunds, disputes, and fulfillments related to the payment.
Vitamarinaweb does not directly store the full payment card details of the user.
Receipts and proof of purchase
For every successful transaction, the payment manager may send the user an electronic receipt or purchase confirmation to the email address provided during the payment process.
The receipt or purchase confirmation is issued according to the payment manager's conditions and constitutes proof of the purchase of the digital package.
Service recipients
Mega Like packages are intended exclusively for consumer users, natural persons, acting for personal and non-professional purposes.
It is not permitted to purchase Mega Like packages as a company, professional, entity, organization, or subject holding a VAT number.
The user declares, by completing the purchase, to act as a natural person consumer and not on behalf of an economic, professional, or commercial activity.
Vitamarinaweb reserves the right to refuse, cancel, or suspend purchases that are found to be made in violation of this rule.
Availability and modifications
Vitamarinaweb may modify, suspend, or interrupt at any time the availability of Mega Like packages, purchasable quantities, connected features, or methods of use, in compliance with rights already accrued by users and applicable legislation.
Any changes will be communicated via the site, app, or other official platform channels.
Refunds
Refunds, where provided, are managed according to applicable legislation, the payment manager's conditions, and Vitamarinaweb's Terms of Service.
Since Mega Likes are digital content/features immediately usable within the platform, the user acknowledges that, after the use of purchased Mega Likes, a refund may not be available, except in cases mandatorily required by law or the payment manager.
Abuse and account suspension
In case of abuse, fraud, improper use, violation of the Terms of Service, or suspicious activity, Vitamarinaweb may adopt proportionate measures, including:
* temporary account suspension;
* removal of irregularly obtained or used Mega Likes;
* limitation of functionalities;
* cancellation of suspicious operations;
* account closure in the most serious cases.
The user shall not be entitled to any compensation for Mega Likes removed or canceled following violations of the Terms of Service.
Tax aspects
The purchase and use of Mega Likes do not generate any income for the users who receive them, as Mega Likes are not convertible into cash and do not entitle the user to payouts, economic prizes, or compensation.
Any tax obligations related to the sale of digital packages, where applicable, are handled according to the payment model used, the conditions of the Merchant of Record or payment provider, and current legislation.
Acceptance
By purchasing or using Mega Likes, the user declares to have read, understood, and accepted these conditions.
Vitamarinaweb is not intended for individuals under the age of 18.
Access to and use of the service are strictly reserved for users who declare they are at least 18 years old.
During registration or login via third-party authentication systems (such as Apple, Google, or others), Vitamarinaweb is unable to verify the actual age of the user and relies exclusively on the declarations provided by them.
The user, by registering or using the service, declares under their own responsibility to be of legal age.
Vitamarinaweb does not intentionally collect or process personal data of minors.
If the Owner becomes aware of the access or use of the service by a minor, they will promptly suspend or delete the account and remove any processed data, except as necessary to comply with legal obligations.
Any false declaration regarding age entails the assumption of exclusive responsibility by the user.
Cookies:

Why do we process your data?
Moderation and IP protection (legitimate interest): we process the data necessary to prevent and manage violations of law/rights (e.g., technical logs, account IDs, reported URLs), keeping them for the time strictly necessary to handle the report.
The security of customer data is our priority, therefore we only process user data strictly necessary to manage the site. Information collected automatically is used only to identify potential cases of abuse and establish statistical information regarding website usage. This statistical information is not aggregated in such a way that would identify any particular user of the system.
Vitamarinaweb is not intended for individuals under the age of 18 and does not intentionally collect or process personal data referring to minors.
During registration and access to the service, including via third-party authentication systems (such as Apple, Google, or others), Vitamarinaweb is unable to verify the actual age of the user and relies exclusively on the declarations provided by the user.

🐚 Data processing for newsletter subscription
VitamarinaWeb collects and processes personal data voluntarily provided by users (email address, date, and IP address) exclusively for sending the informative newsletter.
Subscription to the newsletter is optional and subject to the user's explicit consent by ticking the appropriate box in the registration form.
The collected data are used to:
send updates, articles, and news regarding the sea, marine biology, and sustainability;
inform the user about events and projects related to VitamarinaWeb.
Legal basis of processing: consent of the data subject pursuant to art. 6, par. 1, let. a) of the EU Regulation 2016/679 (GDPR).
Data will be kept until the user revokes consent, which can occur at any time via the "Unsubscribe" link present in each email or by writing to aaa411@hotmail.it.
Data will not be transferred to third parties, nor transferred outside the European Economic Area.

When you click "Save my location" we record lat/long, accuracy, date/time, and note.
Locations are private by default. If you choose "Make public", we show an
approximate (coarse) location to other users. Legal basis: performance of the service (private part)
and CONSENT for the public part, revocable at any time. Retention: as long as you have the account
or until you delete it; in the absence of activity, we may remove it after 24 months.
Maps may load resources from third parties (e.g., OpenStreetMap/CDN) who receive the device's IP.

Geolocation
When the user presses "Save my location" we record lat/lon, precision, date/time, and note.
Legal basis: execution of the service for private saving; consent for publication of the location (revocable at any time).
The feature of public sharing of location is strictly reserved for users who declare they are at least 18 years old.
Vitamarinaweb is unable to verify the actual age of users and relies on the declarations provided by them upon registration or use of the service.
In case of false declarations regarding age, the user assumes all responsibility. Should the Owner become aware of the use of the service by a minor, they will promptly disable the feature and delete any processed data, except as necessary for legal obligations.
Public locations are shown in approximate form (reduced precision).
No continuous tracking: the location is sent only when the user presses the button.
Retention: until deletion by the user or account closure; in the absence of activity, we may remove it after 24 months.

Protection via reCAPTCHA
To protect registration and contact forms, we use the Google reCAPTCHA service.
This system identifies suspicious activity (such as bots or spam) by analyzing certain technical data (for example IP address, browsing behavior, time spent on the page).
This data is transmitted directly to Google, which processes it as an independent data controller according to its Privacy Policy available here: https://policies.google.com/privacy.

Exemption from liability as an hosting provider
Vitamarinaweb operates as a hosting service provider pursuant to Legislative Decree 70/2003: it has no general obligation to prior monitor user content. However, we have an obligation to remove or disable access to illegal content "without undue delay" when we become aware, with suitable methods, of their illegality.
